General Terms and Conditions (GTC) of Parfümerie Douglas GmbH & Co. KG for distance selling and electronic commerce via douglas.de or telephone for purchases by private customers with a billing address in Germany at Douglas

§ 1 Scope 

For your orders of goods from Douglas, the purchase of Douglas gift cards via douglas.de or by telephone on 0800-7 444 777, the following general terms and conditions of Parfümerie Douglas GmbH & Co. KG, Luise-Rainer-Str. 7-11, 40235 Düsseldorf, Germany (telephone: 0800/690 690 5, email: [email protected] ), in the version valid at the time of the order, apply exclusively - provided that this does not deprive you of further consumer protection at your place of residence in Europe.

You can download the text to your computer or print it out. Any provisions deviating from these terms and conditions are only valid if they have been confirmed by us in writing.

§ 2 Conclusion of contract 

(1) Our information on goods and prices within each order process is non-binding and subject to change. Rather, by placing your order using the "Buy Now" button, you are making a binding offer to purchase, which still requires our acceptance. The purchase contract for the goods is only concluded when your order is accepted. We are not obliged to accept your offer to purchase.

(2) Your order will be accepted by us when and to the extent that we confirm the dispatch of the goods or the Douglas voucher card by email.

You may not pass on a password required for an order to a third party. If you pass it on, you are also responsible for the third party's orders. You are responsible for all orders made with your password and any claims resulting from them.

(3) We do not store the contract text. Before submitting the order, the contract data can be printed out or saved electronically using the browser's print function.

§ 3 Cancellation Policy

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.

if you have ordered one or more goods as part of a single order and the goods are delivered as a single item;

if you have ordered several goods as part of a single order and the goods are delivered separately;

If several of the above alternatives apply, the cancellation period only begins when you or a third party other than the carrier designated by you has taken possession of the last goods or the last partial delivery or the last item.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

consequences of revocation

If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund.

We may refuse repayment until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us that you have cancelled this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.

The following applies to the costs of return: If you use a prepaid return label provided by us, the return is free of charge for you. You can obtain a return label from our customer service ( [email protected] or by calling the free number 0 800 - 690 690 5). If you do not use our return label, you will have to bear the direct costs of the return.

You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

§ 4 Delivery

(1) Standard deliveries within Germany are free of shipping costs for orders over 39.95. The order total is the subtotal for all products in an order (regardless of whether they are delivered by Douglas itself and/or by a Douglas partner) minus all discounts. If the order total is less than this amount, we charge a flat rate of 4.95 euros for delivery within Germany. For many products, there are also some special delivery options, such as express delivery. If special delivery options cannot be selected during the ordering process, they are unfortunately not available.

(2) Standard deliveries in Germany are made to the delivery address specified when ordering. Depending on the shipping method, delivery can also be made to a DHL Packstation, a Douglas branch, a Hermes parcel shop or a post office within Germany. These options can be selected during the ordering process if available; otherwise they are not available for the respective order and/or product. Delivery to PO box addresses is not possible.

With standard delivery via DHL or Hermes within Germany, your order will be delivered within 1-3 working days.

(3) Additional costs may arise for express deliveries. Such orders can only be sent to addresses within Germany. Express delivery (excluding deliveries to packing stations) is only possible on the German mainland.

If you require express delivery, the following applies (if you pay with PayPal, these times may vary in individual cases):

You choose express delivery and order Monday to Friday before 2 p.m.:
Your goods will leave our warehouse on the same day and can be delivered to you by our express service provider by 12 p.m. the next working day.

You choose express delivery and order Monday to Thursday after 2 p.m.:
Your goods will leave our warehouse on the following working day at the latest, so that our express service provider can deliver them to you by 12 p.m. on the working day after next.

You choose express delivery and order after 2 p.m. on Friday:
Your goods will leave our warehouse on Monday at the latest so that our express service provider can deliver them to you by 12 p.m. on Tuesday.

Please note that once the goods have been delivered to the express service provider, we can no longer influence the movement of the goods. Therefore, we can only guarantee that they will be delivered to the express service provider on time. You can find more information about the services provided by the express service providers on their websites.

Please take a look at the following example table:

The cost of express delivery is a standard 10.95 euros. This also applies if a shipment would be free of charge according to the usual shipping model. These costs may vary during promotional periods.

Express orders from and express deliveries to companies are excluded from Saturday delivery. If you are a private individual ordering to a company address, delivery is possible on Saturdays.

(4) We expressly reserve the right to change, extend, restrict or partially or completely discontinue the special delivery methods mentioned in the aforementioned § 4 paragraphs 2 and 3 at any time and without stating reasons and to no longer offer them in part or in whole. The standard delivery method according to § 4 paragraph 1 is excluded from this.

(5) Public holidays and holidays, which vary within Germany, affect the delivery time of your order and lead to a postponement of delivery by up to two working days following the holiday.

(6) We are entitled to make partial deliveries if this is reasonable for you based on a balance between your interests and ours. In the case of partial deliveries, we will of course bear the additional shipping costs incurred. Partial deliveries are sent at our risk. The risk for the delivered items passes to you upon receipt of each partial delivery. If we are in default with outstanding partial deliveries or are unable to make outstanding partial deliveries, you are entitled to withdraw from the contract in its entirety or to demand compensation for non-fulfillment of the entire obligation whenever the partial delivery is not of interest to you.

§ 5 Means of payment, discounts, due date and default 

(1) Depending on the amount of your order and the balance of your customer account at douglas.de, a credit check will only be carried out if you have chosen a payment method with a risk of default.
You will be offered a choice of the following payment options:

a. invoice

b. Credit card (American Express, Mastercard, VISA card or Diners)

c. Douglas Card

d. PayPal

e. Douglas voucher with PIN (see § 6)

f. Sofortüberweisung (Klarna) or

g. Installment purchase via Klarna (Slice it).

The means of payment are restricted, in particular if the delivery address differs from the billing address or if a Douglas voucher card is purchased.

If you order via douglas.de in a Douglas branch in Germany, you can pay immediately on site in the branch or when picking up the goods using the usual payment methods used in Douglas branches.

(2) Discounts or discount vouchers (e.g. a voucher with a discount code, a newsletter bonus, or a birthday voucher) can only be redeemed under the respective promotional conditions. Multiple discounts and discount vouchers cannot be combined.

(3) No discounts are granted on books and gift cards.

(4) The purchase price is due upon complete delivery, i.e. handover of the goods or the Douglas gift voucher cards.

Your account will be debited at the earliest possible date, depending on the payment method selected. When purchasing on account, the purchase price must be credited to the account specified on the invoice no later than 14 days after delivery.

When paying by direct debit, the invoice amount will be debited from your specified account 2 days after the invoice date.

If you want to pay when picking up the goods at a Douglas branch, the invoice amount is only due when the goods are picked up at the selected German Douglas branch. The goods will be held for collection for a maximum of 10 days.

Otherwise, your account will be debited at the next possible date, depending on the payment method you have chosen.

(5) If the invoice amount to be paid is not credited to our account on time when purchasing on account, you will automatically be in default. In this case, we reserve the right to charge a reminder fee of EUR 1.50 (payment reminder) and a reminder fee of EUR 2 (final reminder) in addition to the invoice amount. Even without a further reminder, you will then be obliged to pay the statutory default interest of five percentage points above the respective base interest rate announced by the European Central Bank and any further damage caused by the delay, in particular any further collection costs. However, you are entitled to prove in any case that no or less damage has been caused.

The same applies if the invoice amount was to be paid by direct debit, credit card (American Express, Master Card, VISA Card or Diners), Douglas Card, PayPal or Douglas voucher card, but was rejected by the account-holding institution or was not paid within 30 days of the invoice date.

(6) The delivered goods remain our property until full payment has been made. In the event of a breach of contract on your part, in particular in the event of late payment, we are entitled to take back the delivery item after setting a reasonable deadline; you are obliged to hand it over.

§ 6 Douglas voucher cards/ PDF vouchers with 4-digit PIN

(1) Douglas gift cards/PDF vouchers with a 4-digit PIN can be purchased online using all payment methods described in Section 5 and cannot be used to purchase additional gift cards via douglas.de.

(2) When using gift cards/PDF vouchers as a means of payment, the balance on the respective gift card at the time of redemption applies. The balance on Douglas gift cards/PDF vouchers does not bear interest and cannot be paid out in cash.

(3) Douglas accepts no liability in the event of loss, theft or illegibility of voucher cards/PDF vouchers.

(4) Douglas reserves the right to refuse payment with gift cards/PDF vouchers in individual cases if payment is not possible due to a technical fault.

(5) Up to three gift cards/PDF vouchers can be redeemed per order. Their value will be used for the current order and automatically deducted from the order value. Any remaining amounts not covered by the gift cards can be paid using one of the other payment methods listed above.

(6) If purchased goods are returned, the customer will receive a refund of the purchase price paid. If voucher cards/PDF vouchers were used in addition to other means of payment for this purchase, a refund will be made primarily in the payment method that the customer chose in addition to voucher cards. If the amount not paid with voucher cards is exceeded, the refund will be made as a PDF voucher. This PDF voucher will be sent to the email address specified in the original order. The value of the PDF voucher can only be redeemed in full at douglas.de and in all German Douglas branches.

§ 7 Claims for Defects

(1) The product images do not always have to match the appearance of the products delivered. In particular, changes in the appearance and features of the products may occur after manufacturers renew their product ranges. Claims for defects do not exist insofar as the changes are reasonable for the customer.

(2) If the goods are defective, we will provide subsequent performance within a reasonable period of time, i.e. either a replacement delivery or the removal of the defects. If the subsequent performance you have chosen is only possible at disproportionate expense, we are entitled to provide subsequent performance in another form. The costs required for subsequent performance will be borne by us. If we are unable to provide subsequent performance, you have the right to cancel the purchase or reduce the purchase price.

(3) Defective goods must be returned to us unless you have decided to reduce the purchase price.

(4) Claims for defects shall expire within 2 years from the date of delivery of the goods.

(5) The costs for return shipment in case of a defect shall be borne by us.

§ 8 Damages

Compensation for damages due to a breach of an obligation arising from the contractual relationship must be paid under the statutory conditions. The same applies to claims for damages based on the Product Liability Act. All instructions on the packaging and inserts must be observed. No liability is accepted for any use and/or handling that deviates from this.

§ 9 Return of batteries

You can return used batteries to us free of charge.
Batteries containing harmful substances are marked with the symbol and one of the chemical symbols

Cd (= battery contains cadmium), Hg (= battery contains mercury) or Pb (= battery contains lead).

Lithium batteries and battery packs of all systems may only be returned to us in a discharged state. If batteries of this type are not completely discharged, please insulate the battery poles with adhesive tape before returning them.

§ 10 Alternative Dispute Resolution

The EU Commission has provided a platform for out-of-court dispute resolution. This gives consumers the opportunity to resolve disputes relating to their online order without having to go to court. The dispute resolution platform can be reached via the external link http://ec.europa.eu/consumers/odr/ .

We will endeavour to resolve any disagreements arising from our contract amicably. Furthermore, we are not obliged to participate in an arbitration procedure and unfortunately cannot offer you the opportunity to participate in such a procedure.

§ 11 Miscellaneous

(1) We reserve the right to change the general terms and conditions at any time. These are available in their current version at any time on douglas.de, as a PDF file for printing here  .

(2) German law applies to our customers in Germany. For customers residing abroad, the sales law of the country in which the customer normally resides applies.

(3) Claims and complaints may be made to the address specified in Section 1.

(4) Various factors are used to determine the results in recommendation systems in order to tailor them as personalized as possible to customer interests. The main influencing factors are the respective country, the article information and previous orders (for online purchases) and, in the case of Beauty Card customers, previous purchases in the stores. In addition, information from browsing behavior is also included in the display of recommendations, i.e. the way in which customers move around the online shop. This includes, for example, views of product detail pages, search queries and created and completed shopping carts. In addition to this information, product parameters also influence the recommendations displayed. This includes the popularity of the products, based on clicks, shopping carts, wish lists and orders, but also the price of the products and the respective brand. Individual recommendation areas can also use further product information, such as the time of the launch of a product or the price as a filter criterion.

The most important factor in displaying results in recommendation systems is browsing behavior, with a particular focus on clicks and purchases. The price and popularity of the products are taken into account secondarily. Other parameters, such as product attributes or the respective brand, can also be used for certain areas depending on the recommendation logic set.

(5) You have the option of reporting third-party content to Douglas that may violate laws, general terms and conditions or Douglas guidelines. Third-party content can be reported using the "Report violation" button. The report is then forwarded to the responsible department for review. After careful review by the relevant departments, a notification will be sent of the decision made and, if applicable, action taken, unless the report was made anonymously.

You have the opportunity to appeal against the decision within six months of being notified of the decision. In this case, the decision will be re-examined by the relevant department.
